PLEASE NOTE - We reserve the right to change these Terms from time to time. Your continued use of the Website after they have been posted means that you agree to be bound by the Terms as revised. It is therefore important that you check these Terms regularly.
1. INTELLECTUAL PROPERTY
i) All rights to the Website and its contents including, but not limited to, the "www.whattodowiththekids.co.uk" names and logos, are owned wholly by us and cannot be replicated or reproduced in any way without our express approval.
ii) The Website may only be used for lawful purposes that do not restrict anyone else’s enjoyable use of the site.
2. WEBSITE CONTENT
i) The content of this Website, including all information, contributions, offers and attraction information, is provided ‘AS IS’. We expressly make no warranty about, and assume no liability or responsibility for: Contributions, the conduct of users of the Website, third party advertisements, products or services which feature on the Website or third party websites linked to the Website (or the contents or opinions expressed in any of them), nor do we accept any obligation to monitor, investigate or check any of the above; or for the Website, the Contributions or its other contents and/or the services being provided through it being fit for any particular purpose, safe, secure, accurate, reliable, non-infringing or free of defamatory, offensive or otherwise objectionable material, or being uninterrupted, or free from errors, bugs, viruses, Trojan horses, worms or similar.
ii) By using or submitting any information to the site you agree to indemnify and hold harmless the owners of www.whattodowiththekids.co.uk, its affiliates and sub-licensees against any and all claims, liabilities, losses, damages, costs and expenses (including but not limited to legal expenses) which any of them may incur or suffer arising out of or in connection with your use of and access to the Website, your contributions and/or any breaches of the warranties, representations or other obligations set out in these Terms.
iii) Website users are permitted to post, upload, or otherwise make available on the site (collectively, "submit") content in some areas of the website, for example the attraction search. This content may include text, illustrations, files, images, graphics, photos, comments, information, content, and/or other materials ("User Content"). We have the right to publish, edit or reject any User Content that you send us either via email, via the site or in writing via post for any purpose whatsoever, commercial or otherwise, without payment to you - unless we have specifically agreed otherwise in writing prior to submission. iv) By submitting User Content to us, simultaneously with such posting you automatically grant to us a worldwide, fully-paid, royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable, and transferable right and license to use, record, sell, lease, reproduce, distribute, create derivative works based upon (including, without limitation, translations), publicly display, publicly perform, transmit, publish and otherwise exploit the User Content (in whole or in part) as www.whattodoiththekids.co.uk, in its sole discretion, deems appropriate. We may exercise this grant in any format, media or technology now known or later developed for the full term of any copyright that may exist in such User Content. v) Subject to the rights and license you grant to us under these Terms of Use, you retain all your right, title and interest in your User Content submissions. This means that copyright in your User Content will remain with you and that you can continue to use the material in any way, including allowing others to use it. vi) You agree that you will not submit any User Content protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property, personal, contractual, proprietary or other right owned by a third party without the express permission of the owner of the respective right. You are solely liable for any damage resulting from your failure to obtain such permission or from any other harm resulting from User Content that you submit. You represent, warrant, and covenant that you will not submit any User Content that: - violates or infringes in any way upon the rights of others, including, but not limited to, any copyright, trademark, moral right, or other third party right of any person or entity;- impersonates another or is unlawful, threatening, abusive, libelous, defamatory, invasive of privacy or publicity rights, obscene, harassing or otherwise objectionable;- contains a formula, instruction, or advice that could cause harm or injury;- the licensed use by us hereunder would result in us having any obligation or liability to any party. We rely on you to present us with User Content that contains accurate and factual material. We assume no responsibility for the accuracy of information provided on www.whattodowithekids.co.uk
3. COMPETITION TERMS AND CONDITIONS
In addition to any terms and conditions specified on each competition web page, the following terms and conditions apply to all competitions on www.whattodowiththekids.co.uk
i)To enter, you must be (a) A UK resident; and (b) 18 years old or over at the time of entry ii) Competition is not open to employees (or members of their immediate families) of www.whattodowiththekids.co.uk or anyone promoting the competitions.iii) www.whattodowiththekids.co.uk may cancel or amend any competition, competition information, or these terms and conditions without prior notice. Any changes will be posted either within the competition information or these terms and conditions.iv) All entries must be made in accordance with the entry procedure set out on the competition web page.v) No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason.?vi) The winner will be chosen at random from all those entrants (who have selected the correct answer where required).vii) Only one entry per person.viii) If you win, we will notify you by e-mail.ix) If we do not get a response to the email within two weeks, or within the time specified in the email notification we send to the winner, we reserve the right to offer the prize to a runner-up.x) If the runner up does not respond or is unable to accept the prize it will then be offered to another runner up, and so on.xi) Our decision will be final, and no correspondence will be entered into.xii) The prize is not exchangeable for cash or any other prize.?xiv) Incorrectly completed entries will be disqualified.xv) By entering a competition on www.whattodowiththekids.co.uk, you agreeing for any contact details which you submit, including the email address you use to submit your entry, to be used for communications from www.whattodowiththekids.co.uk. Your details will be used solely for communications from www.whattodowiththekids.co.uk unless: a) you are a winner or a runner up in a competition, in which case your contact details will be shared with the prize promoter so that they are able to send your prize to you, or b) in such cases where we have expressly stated on the competition page that by entering the competition, you are agreeing that your details will be shared with a third party.
4. VOUCHERS
www.whattodowiththekids.co.uk features all vouchers in good faith and endeavours to keep all promotions on the site accurate and up to date.
The attractions participating in voucher promotions are entirely responsible for informing www.whattodowiththekids.co.uk of any change to the terms and conditions of their offer.
www.whattodowiththekids.co.uk will not take responsibility for any customer complaint or compensation claim arising from an attraction failing to inform us of a change to the promotion on offer, or from a refusal to accept a voucher for any reason not explicitly stated in the agreed terms and condition of the offer.
5. PERSONAL DATA
i) "Personal Data" is any data that identifies you. We will deal with your Personal Data in compliance with the current UK data protection legislation. Please note this applies only to whattodowiththekids.co.uk not to other companies' or organisations' websites to which we link.ii). Personal Data may be collected, processed and used by whattodowiththekids.co.uk in the course of providing the whattodowiththekids.co.uk service to you andthe other purposes mentioned below. Personal Data may also be processed and used by such other organisations on our behalf for the purpose of providing the whattodowiththekids.co.uk service to you. The use of information will remain under the control of whattodowiththekids.co.uk at all times.iii) Only if you have given us permission, either by agreeing to the terms and conditions of entering a www.whattodowiththekids.competition as outlined above, or by subscribing to our email list, will we send you communications about new products and services which we consider may be of interest to you.iv) We may collect Personal Data about your usage of the whattodowiththekids.co.uk service in order to provide a service to meet your needs, and to let you know about products and services that may be of interest to you. However, the data will only be disclosed on an anonymous and aggregated basis not in a way in which you will be identified.v) We may hold Personal Data relating to the transactions you enter into with us or others through the whattodowiththekids.co.uk service such as an online seller.
